The ERA has just passed in Virginia. The vote in the House of Delegates was 59-41. The vote in the Senate, under an hour later, was 28-12.
This now makes 38 states to ratify it. Two issues remain. The deadline passed by Congress originally was 1979, later extended to 1982. However, the deadline was not in the text of the Amendment. Many feel that a deadline is not constitutional (and if it is, then Congress can remove or extend it again). The Obama Justice Department ruled that it was not constitutional, the Trump Justice Department said that it was. Obviously a court will have to adjudicate.
The other issue is that 4 states rescinded their ratification. In the case of the 14th Amendment, a state’s recission was not accepted, since the Constitution doesn’t mention it. Again, a court will have to decide the matter.
But it is a great day in the Commonwealth! And a great day for the country.
